Art for Charity Store Terms of Participation

Your participation on the Redeemer’s Heart Art for Charity Store is conditioned upon Your acceptance of these legal terms of participation. Redeemer’s Heart reserves the right, in its sole discretion, to modify or update these legal terms of use from time to time with immediate effect and without advance notice to You. It is Your responsibility to review these legal terms of participation periodically for updates. AFTER READING THESE LEGAL TERMS AND CONDITIONS OF PARTICIPATION, IF FOR ANY REASON YOU DO NOT AGREE WITH OR CANNOT ABIDE BY THESE TERMS, PLEASE DO NOT SUBMIT ARTWORK FOR CONSIDERATION. OTHERWISE, BY SUBMITTING ARTWORK IMAGES OR DONATING ORIGINAL ARTWORK, YOU ARE AGREEING TO THESE TERMS OF PARTICIPATION
LIMITATION OF LIABILITY In no event shall Redeemer’s Heart, its directors, evangelist leadership team members, members, or volunteers, be liable for any damages of any kind, including without limitation any direct, special, incidental, indirect, exemplary, punitive or consequential damages.
INDEMNIFICATION You agree to defend, indemnify and hold Redeemer’s Heart harmless from and against any and all claims, damages, costs and expenses, including reasonable attorney’s fees, arising from or related to Your participation with the Art for Charity Store.
PLAGIARISM If we believe that you copied for another artist in a way that constitutes plagiarism, your submitted artwork will not be included in the Art for Charity Store. We will do our best to determine this fairly and as accurately as possible.
CONSEQUENCES OF PLAGIARISM VIOLATIONS If Redeemer’s Heart has reason to believe that a submission violates plagiarism rules and the participation terms after it is already in the Art for Charity Store, an investigation into the submission will be opened, which could lead to removal from the Art for Charity Store.
HOW DO I KNOW IF MY WORK IS ORIGINAL? An original work is one that is new and different from what others have created. This means that you are the author of the work, and the work is not copied from someone else’s original work. Even if there is no exact or literal copying, but the average person may notice substantial similarities between the submitted work and the source material, it is possible that the work is not considered original and should not be submitted to the Art for Charity Store.
We understand that artists sometimes create work that references other artists in original and meaningful ways. If your work transforms some sort of source material, then it may be considered original.
We define transformative work as a new work that adds value, substantially changes, comments on, or gives a new expression or meaning to the source. If the submission uses another artist’s work as raw material and transforms the original work by bringing new insights and understandings to the piece, it may be submitted to the Art for Charity Store.
WHAT IF I CITE MY SOURCES? CAN I USE ANOTHER PERSON’S WORK IF I GIVE THEM CREDIT? You may use limited portions of another’s work if you cite your source in your description submitted to us and if the final product is still an original idea. There is no formula or percentage of someone else’s work that is acceptable to use when submitting your work to the Art for Charity Store. What is important is that your finished work is something new and different from your source. If you have any doubt about whether a submission is original, we advise that you choose not to submit that work.
WHAT IF I FIND A WORK THAT WAS SUBMITTED TO THE ART FOR CHARITY STORE THAT ISN’T ORIGINAL? If you suspect that a work was copied from another source or was plagiarized, please let us know by emailing us at admin@redeemersheart.com. We will investigate to determine if the work violates our participation terms.
LIMITED LICENSE OF IMAGES FOR REPRODUCTION ON PRODUCTS YOU OWN YOUR ARTWORK , INCLUDING ANY PHOTOS THAT YOU UPLOAD TO REDEEMER’S HEART FOR USE IN THE ART FOR CHARITY STORE FOR REPRODUCTIONS ON PRODUCTS. We will not claim any ownership of your artwork–it is completely, 100%, yours. However, by submitting artwork to us, you grant us a worldwide, royalty-free license to reproduce, display, adapt, modify, sell, and distribute your artwork (in whole or in part) on any product in our Art for Charity Store for a minimum of six months. You understand that we will not pay you for any use of your artwork. If you would like your artwork removed after six months, please contact us at admin@redeemersheart.com or via the Contact form on the Redeemer’s Heart website and we will remove your artwork at our earliest convenience. 100% of profits after taxes from the sale of artwork reproduced on products in the Art for Charity Store will be given to our featured charity during the time of the sale.
DONATIONS
Original artwork donated to Redeemer’s Heart becomes the sole property of Redeemer’s Heart for sale or auction in the Art for Charity Store in which 100% of the profits after taxes will be given to the featured charity during the time of the sale.
